Conditions of Participation

hereinafter referred to as the organiser, is free of charge and is governed exclusively by these conditions of participation.

 

Eligible participants

Eligibility is open to individuals resident in Germany who have reached the age of 18. Participation is limited to recipients of the Kess newsletter and customers of Kess Berlin GmbH.

Employees of the organiser and its affiliated companies and their family members are not eligible to take part in the competition. In addition, the organiser reserves the right to exclude persons from participation at its own discretion if there are justified reasons, for example

  1. in the event of manipulation in connection with the organisation of the competition,
  2. in the event of violations of these conditions of participation,
  3. in the event of false or misleading information in connection with participation in the competition.

 

    Participation

    Participation in the competition takes place by submitting the completed survey form. By submitting the survey form, the participant accepts these conditions of participation. Participation is only possible until the closing date. Entries received after the closing date will not be considered in the draw.

    The closing date for the competition is 31.08.2020, 23:59. The electronically logged receipt of the survey form by the organiser will be used to verify timely receipt.

    Only one submitted registration per participant will be entered into the competition. It is prohibited to use multiple email addresses to increase the chances of winning.

     

    Winning, notification and transfer of the prize

    The following prizes will be awarded:

    • 1 x Kess beauty set (value of goods totalling €100)

    The winners will be determined after the closing date in a random draw among all participants.

    The winner(s) of the prize draw will be notified by the organiser by email within one week of the closing date. In the event of an undeliverable notification, the organiser is not obliged to make further enquiries and may select a new winner. If the winner does not respond within one week of being notified of the prize, the organiser is also entitled to select a new winner.

    The prize will be handed over exclusively to the winner. It is not possible to exchange, collect or pay out the prize in cash. Prizes in kind will be sent to the winner by post to their home address; the organiser will bear the shipping costs for this. The winner is responsible for paying any taxes on the prize.

     

    Termination of the competition

    The organiser expressly reserves the right to interrupt or terminate the competition at any time without prior notice and without giving reasons and to amend these conditions of participation.


    Data protection

    A personal e-mail address is required to enter the competition. The participant assures that the personal details provided by him/her are true and correct. In the case of non-cash prizes, further personal data, such as address, will be requested from the winners after the end of the competition as part of the prize notification. The collection and processing of personal data is solely for the purpose of organising the competition and, if applicable, sending the prizes. All data will only be stored for the purpose and duration of the competition and will be deleted at the end of the campaign, provided there are no statutory retention obligations.

    Participants' personal data will not be passed on to third parties or made available to them for use without their consent. An exception to this is the company Kess Berlin GmbH, Rosenthaler Str. 40-41, Hackesche Höfe, 10178 Berlin, which has been commissioned to organise the competition, in particular to send the prize, and which collects, stores and uses the data for the purpose of running the competition.

    In the event of a win, the winner agrees to the publication of their name in the advertising media used by the organiser. This includes the announcement of the winner on the organiser's website and its social media platforms.

    The participant can obtain information about their data stored by the organiser at any time, object to the use of their data and request its deletion. A simple letter to Kess Berlin GmbH, Rosenthaler Str. 40-41, Hackesche Höfe, 10178 Berlin or an email to datenschutz@kessberlin.de is sufficient for this purpose.

    Once consent has been withdrawn, the participant's personal data that has been collected and stored will be deleted immediately.

    Liability

    The organiser is not liable for damages caused by errors, delays or interruptions in transmission, malfunctions of the technical equipment and service, incorrect content, loss or deletion of data, viruses or in any other way during participation in the competition, unless such damages have been caused intentionally or through gross negligence by the organiser (its bodies, employees or vicarious agents). The above limitation of liability shall not apply in the event of injury to life, limb or health or in the event of fraudulently concealed defects.


    Applicable law

    The competition is subject exclusively to the law of the Federal Republic of Germany. Legal recourse is exclud

     

    Severability Clause

    Should any provision of these Terms and Conditions of Participation be or become invalid in whole or in part, this shall not affect the validity of the remaining provisions of these Terms and Conditions of Participation. The invalid provision shall be replaced by a legally permissible provision that comes as close as possible to the economic intent and purpose of the invalid provision. The same applies in the event of a loophole in these conditions of participation.
